This AUP applies to all customers, users, and any individual or entity accessing or using the Service in any capacity.
All customers and users of the Service must comply with this AUP, as well as all applicable local, state, national, and international laws and regulations governing electronic communications. This includes, but is not limited to:

- General Data Protection Regulation (GDPR) (European Union) β Rules governing the processing of personal data and electronic marketing communications.
- Canada's Anti-Spam Legislation (CASL) (Canada) β Consent requirements for sending commercial electronic messages.
- Privacy and Electronic Communications Regulations (PECR) (United Kingdom) β Rules governing electronic marketing and the use of cookies and similar technologies.
- Any other applicable anti-spam, data protection, and privacy regulations in the jurisdictions where you or your recipients are located.
This AUP is incorporated into and forms part of our Terms of Service. Any violation of this AUP constitutes a violation of the Terms of Service.
MailLand reserves the right to update or modify this AUP at any time. Changes become effective upon posting to our website. We will provide at least 30 days' notice of material changes via email or a prominent notification within the Service. Your continued use of the Service after the effective date of any changes constitutes acceptance of the updated AUP.
2. Prohibited Content
Users must not send, facilitate the sending of, or use the Service to distribute emails containing any of the following types of content:
- Spam: Unsolicited bulk email (UBE) or unsolicited commercial email (UCE). Any email sent to recipients who have not provided explicit, verifiable consent to receive it is considered spam.
- Phishing: Deceptive emails designed to trick recipients into revealing personal information, login credentials, financial data, or other sensitive information through impersonation or fraudulent representations.
- Scams and Fraud: Advance-fee fraud, lottery scams, fake invoices, business email compromise (BEC), and any other form of fraudulent or deceptive communication.
- Malware: Emails containing viruses, trojans, ransomware, spyware, or any other malicious software, or emails containing links to malicious downloads or compromised websites.
- Adult and Pornographic Content: Sexually explicit material of any kind.
- Hate Speech: Content that promotes violence, discrimination, or hatred against individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin.

3. Email-Specific Requirements
All emails sent through the Mail.Land platform must comply with the following requirements:
3.1 Permission-Based Sending
You may only send emails to recipients who have given explicit, verifiable consent (opt-in) to receive communications from you. Double opt-in (confirmed opt-in) is strongly recommended and may be required for certain sending volumes or use cases. Pre-checked consent boxes, implied consent through unrelated transactions, and consent bundled with other terms do not constitute valid consent under this AUP.
3.2 Working Unsubscribe Mechanism
Every marketing and promotional email sent through the Service must include the following:
- A clearly visible, functional unsubscribe link that allows recipients to opt out of future communications easily.
- Unsubscribe requests must be honored within 10 business days. Prompt processing is expected and delays may trigger enforcement action.
- A one-click unsubscribe header (List-Unsubscribe) is required for all marketing emails to support mailbox provider unsubscribe mechanisms.
3.3 Accurate Sender Identification
All emails sent through the Service must accurately identify the sender. Specifically:
- The "From" address must be valid, monitored, and capable of receiving replies.
- A valid physical mailing address must be included in all commercial emails as required by the CAN-SPAM Act and equivalent regulations.
- Sender spoofing, impersonation of other individuals or organizations, and the use of misleading header information are strictly prohibited.
3.4 Bounce Rate and Complaint Thresholds
Maintaining healthy sending metrics is a condition of using the Service. The following thresholds apply to all accounts:
- Hard bounce rate must remain below 5%.
- Spam complaint rate must remain below 0.1% (1 complaint per 1,000 emails).
Exceeding these thresholds may trigger automatic sending throttling, temporary suspension, or further enforcement action as described in Section 5. MailLand monitors these metrics continuously and will notify you when thresholds are approached or exceeded.
3.5 List Hygiene
Customers are responsible for maintaining clean and up-to-date mailing lists. This includes:
- Regularly cleaning mailing lists to remove invalid email addresses, role-based addresses, and known spam traps.
- Promptly removing hard bounces and unsubscribed recipients from active lists.
- Never re-adding recipients who have previously unsubscribed from your communications.
- Using email validation and verification tools before importing new lists into the Service.
4. Prohibited Actions
In addition to the content restrictions outlined in Section 2, the following actions are strictly prohibited when using the Service:
- Using purchased, rented, borrowed, or scraped email lists from any source. All recipients must have provided consent directly to you.
- Harvesting email addresses from websites, online directories, or social media platforms using automated tools, bots, or scraping software.
- Using email addresses obtained without the recipient's knowledge or explicit consent, including addresses obtained through co-registration without clear and prominent disclosure.
- Attempting to circumvent, bypass, or disable spam filters, rate limits, sending quotas, or other security measures implemented by MailLand or recipient mail servers.
- Engaging in traffic pumping or artificially inflating email volumes to generate fees, consume resources, or manipulate service metrics.
- Sending test emails to real recipients without their prior consent.
- Using the Service to send emails on behalf of third parties without clearly disclosing the relationship between you, the third party, and the recipient.
- Creating multiple accounts to circumvent sending limits, enforcement actions, account suspensions, or any other AUP restrictions.
- Reselling, redistributing, or sublicensing the Service or any part thereof without prior written authorization from MailLand.
- Using the Service to perform network abuse, including but not limited to denial-of-service (DoS) attacks, distributed denial-of-service (DDoS) attacks, port scanning, or unauthorized access attempts against any system or network.
- Interfering with, disrupting, or degrading the integrity, performance, or availability of the Service or MailLand's infrastructure, including the systems and networks of other MailLand customers.
5. Enforcement
MailLand takes violations of this AUP seriously and enforces it to protect our platform, our customers, and the broader email ecosystem. Enforcement measures include the following:
5.1 Monitoring
MailLand continuously monitors sending patterns, bounce rates, complaint rates, and email content for compliance with this AUP. Automated systems may flag suspicious activity, unusual sending patterns, or content that appears to violate this policy. Monitoring is conducted to maintain the integrity and deliverability of the platform for all customers.
5.2 Investigation
MailLand reserves the right to review email content, sending practices, recipient lists, and account activity when a violation of this AUP is suspected or reported. Investigations are conducted by our trust and safety team.
5.3 Escalation Path
Enforcement actions are applied proportionally based on the severity and frequency of the violation:
- Warning and Remediation Request: For first-time or minor violations, we will issue a written warning and request that you correct the issue within a specified timeframe.

- Phishing or impersonation attacks

- Illegal activity of any kind conducted through or facilitated by the Service
- Any activity that poses an immediate threat to the security, integrity, or reputation of MailLand's infrastructure or services
5.5 No Refund
Accounts terminated due to violations of this AUP are not eligible for refunds of any prepaid fees, credits, or unused balances. This applies regardless of the remaining duration of any subscription or prepaid plan.
5.6 Appeal Process
Customers may appeal enforcement actions by contacting [email protected] within 14 days of the enforcement action. Appeals must include a detailed explanation of the circumstances and any corrective measures taken. All appeals are reviewed by the trust and safety team, and we will respond with a decision within a reasonable timeframe. MailLand's decision on appeals is final.
6. Reporting Violations
If you believe that a Mail.Land customer is violating this Acceptable Use Policy, we encourage you to report it. You can submit a report through either of the following channels:
- Email: [email protected]
- Report Abuse Form: Report Abuse
When submitting a report, please include as much information as possible to help us investigate effectively:
- Full email headers of the offending message
- The complete message content (body and any attachments)
- A description of the violation and how the email was received
- Any additional context, such as the date and time the email was received, and your relationship (or lack thereof) with the sender
We investigate all reports promptly and take appropriate enforcement action as described in Section 5. To protect the privacy and security of all parties involved, we may not be able to disclose the specific outcome of an investigation to the reporting party.
